You have full permission to bundle any Promise related source code and binary files in the Debian Linux distribution.
 
As a note, as you may be aware, Jeff Garzik w/Red Hat is developing a completely open-source solution for Promise. This leverages libATA under the SCSI layer - although it may not help Debian since it was included in the 2.6 branch and doesn't touch 2.2 and only select versions of 2.4.
 
Also, I may add that Red Hat doesn't push kernel driver development for anyone's health anymore ;-) They have a vested interest in doing this development.
